STATEMENT by General Prosecutor's Office of Republic of Azerbaijan
Since September 27, 2020, the armed forces of Armenia have grossly violated the norms and principles of international law, the Geneva Conventions of 1949 and their Additional Protocols, the decisions and resolutions of the UN Security Council, as well as the requirements of the declared humanitarian ceasefire regime, deliberately targeting the peaceful population of Azerbaijan, making rocket and heavy artillery attacks on our cities and districts that do not belong to the region where military operations are conducted.
On October 28, 2020, at about 13:00 (GMT +4), the Armenian armed forces fired two 300-mm 9M525 type missiles with a 9N235 cluster warhead containing 72 fragmentation combat elements (totally 144) from the Smerch multiple-launch missile system on the busy area of Barda city. As a result, 21 people, including five women, were killed, and 70 people, including eight children and 15 women, received injuries of varying severity.
In addition, the rocket strikes damaged over 30 civil infrastructure objects, more than 20 private residential houses and 22 vehicles.
In connection with the fact, a criminal case was initiated under the Articles 120.2.1 of the Criminal Code (intentional homicide by a criminal organization), 120.2.4 (committed with special cruelty or in publicly dangers way), 120.2.12 (attempted murder with intent to incite national, racial, religious hatred or enmity), 100.2 (waging an aggressive war) and other articles, and preliminary investigation was entrusted to the Investigation Department of the General Prosecutor's Office.
At present, the prosecutor's office is carrying out investigative and operational measures that are possible under the current conditions.
The General Prosecutor's Office of the Republic of Azerbaijan declares that all possible measures will be taken by appealing to international institutions in order to once again expose the invading and aggressive nature of Armenia at the international level, bring the guilty persons to justice and apply sanctions according to international and national legislation.
